Birthday Party Booking Agreement & Terms and Conditions

By booking a birthday party, private event, or reservation at Enchanted Indoor Playground (“Enchanted,” “we,” “our,” or “us”), the individual completing the reservation (“Client,” “Host,” or “you”) acknowledges that they have read, understood, and agree to the following Terms and Conditions. These Terms form a legally binding agreement.

Booking & Non-Refundable Deposit
A non-refundable deposit is required to reserve a party date, time, and event space.
The deposit:

  • Secures Enchanted’s availability for your reservation;

  • Removes the reserved time slot from inventory and availability to other customers;

  • Covers administrative preparation, staffing, scheduling, and operational costs associated with your reservation;

  • Is applied toward the total balance due.

By booking, Client acknowledges and agrees the deposit is earned upon receipt and is non-refundable under all circumstances, including but not limited to:

  • Cancellation by Client;

  • No-show;

  • Reduction in guest count;

  • Illness;

  • Weather;

  • Scheduling conflicts;

  • Failure to comply with Enchanted policies;

  • Removal from the facility for safety or conduct reasons.

Client agrees the non-refundable deposit is a fair and reasonable estimate of damages incurred by Enchanted when a reserved event is cancelled or not fulfilled.

Final Payment & Additional Charges
The remaining party balance is due upon arrival on the event date unless otherwise agreed in writing.
Any additional charges incurred during the event, including but not limited to:

  • Additional children or adults,

  • Package upgrades,

  • Added time,

  • Food or décor add-ons,

  • Cleaning fees,

  • Damage fees,

  • Overtime charges,

must be paid no later than 30 minutes prior to the scheduled end time of the reservation.
Enchanted reserves the right to charge the payment method on file for unpaid balances, damages, overtime, cleaning fees, or policy violations authorized under this Agreement.
Returned payments, chargebacks, or disputed charges may result in additional administrative fees, collection activity, and loss of future booking privileges.

Guest Count, Admissions & Capacity Limits
Each party package includes a specific number of child and/or adult admissions as stated in the selected package.
The RSVP child count provided by Client is considered the guaranteed minimum chargeable attendance.
Guest count reductions made after 48 hours prior to the event will not reduce pricing or balances owed.
Additional guests may be accommodated only if capacity permits and additional admission fees are paid.
Enchanted strictly enforces occupancy limits in compliance with:

  • California fire code requirements,

  • Local occupancy laws,

  • Safety regulations,

  • Insurance limitations.

Guests exceeding approved occupancy limits may be denied entry without refund or compensation.

Arrival, Event Timing & Overtime
Party hosts may arrive up to 15 minutes prior to the scheduled reservation start time unless otherwise approved in writing.
The play floor and party room may not be accessible before the permitted arrival time due to cleaning and preparation requirements.
Reservations begin and end promptly at the scheduled times.
Late arrival by Client or guests does not extend the reservation duration or reduce charges owed.
Additional time may be purchased only if:

  • Space is available,

  • Staffing permits,

  • Payment is completed in advance.

Unauthorized occupancy beyond the reservation end time will result in overtime fees of $50 per 15-minute increment (or portion thereof).

Enchanted reserves the right to remove guests or belongings from party spaces after the reservation concludes.
Repeated overtime violations may result in denial of future reservations.

Decorations, Setup & Property Restrictions
Only decorations approved by Enchanted may be brought into the facility.
The following items are strictly prohibited:

  • Confetti,

  • Glitter,

  • Piñatas,

  • Open flames or candles not approved by staff,

  • Sparklers,

  • Fog or smoke machines,

  • Nails, screws, staples, hooks, tape, adhesives, or wall fasteners,

  • Unsafe or oversized decorations.

Clients are financially responsible for any damage caused by guests, vendors, decorations, or party materials.
Balloon arches, specialty décor, themed setups, and custom installations are included only if specifically listed in the purchased package.

Enchanted reserves the right to remove any decoration or item deemed unsafe, inappropriate, disruptive, or damaging.

Food & Beverage Policy
Outside food and beverages may be permitted only in accordance with Enchanted policies and designated party areas.
Alcohol, illegal substances, smoking, vaping, and intoxicating substances are strictly prohibited anywhere on the premises.
Enchanted reserves the right to immediately terminate an event without refund if alcohol, illegal substances, or unsafe behavior is observed.
Client assumes full responsibility for:

  • Food allergies,

  • Dietary restrictions,

  • Food handling,

  • Food served by outside vendors or guests.

Enchanted is not responsible for allergic reactions, foodborne illness, or issues arising from outside food or beverages.

Supervision, Waivers & Safety Rules
All children must remain under active adult supervision at all times.
Enchanted is an indoor playground and family entertainment facility — not a daycare, drop-off program, or childcare provider.
Enchanted staff supervise facility operations and enforce rules but do not provide individual child supervision.
All guests entering the facility may be required to complete a waiver and comply with facility rules.
For safety reasons, Enchanted reserves the right to:

  • Remove any guest engaging in unsafe, aggressive, destructive, inappropriate, or disruptive behavior;

  • Restrict access to equipment based on age, size, or safety concerns;

  • End an event without refund if conduct threatens the safety of guests, staff, or the facility.

Parents and guardians remain fully responsible for the conduct, supervision, and safety of minors attending the event.

Assumption of Risk & Release of Liability
Client acknowledges that participation in playground and recreational activities involves inherent risks, including but not limited to:

  • Slips,

  • Falls,

  • Collisions,

  • Equipment-related injuries,

  • Illness exposure,

  • Physical injury.

By entering the facility, Client voluntarily assumes all risks associated with participation.
To the fullest extent permitted by California law, Client agrees to release, waive, and hold harmless Enchanted Indoor Playground, its owners, officers, employees, contractors, and affiliates from any claims, liabilities, damages, injuries, losses, or expenses arising from:

  • Participation in activities,

  • Use of equipment,

  • Actions of guests,

  • Negligence of other patrons,

  • Illness exposure,

  • Property loss or theft,
    except where caused by Enchanted’s gross negligence or willful misconduct.

Illness & Health Policy
Guests who are sick, experiencing symptoms of illness, fever, vomiting, diarrhea, contagious conditions, or other health concerns should not attend.
Enchanted reserves the right to deny entry or request removal of visibly ill guests for the health and safety of others.
No refunds or credits will be issued due to illness-related nonattendance.

Photography & Marketing
Enchanted may photograph or record general activity within the facility for operational, promotional, or marketing purposes.
By attending, Client grants Enchanted permission to use photographs or video containing attendees in promotional materials, social media, advertising, or marketing unless Client submits a written opt-out request before the event.

Damage, Theft & Cleaning Fees
Client accepts responsibility for damages caused by guests, vendors, or attendees during the reservation.
Charges may be assessed for:

  • Excessive mess,

  • Property damage,

  • Missing décor,

  • Theft,

  • Bodily fluid cleanup,

  • Improper disposal of prohibited items,

  • Rule violations requiring additional labor or cleaning.

Enchanted reserves the right to charge the payment method on file for verified damages or losses.

Force Majeure
Enchanted shall not be liable for cancellations, interruptions, or inability to perform due to events beyond reasonable control, including but not limited to:

  • Natural disasters,

  • Government orders,

  • Power outages,

  • Severe weather,

  • Public health emergencies,

  • Labor shortages,

  • Utility failures,

  • Emergencies affecting safe operation.

In such situations, Enchanted may, at its sole discretion, offer rescheduling subject to availability.

Refunds, Rescheduling & Cancellation Policy
Deposits are non-refundable.
Rescheduling requests may be considered at Enchanted’s sole discretion if requested at least 21 days before the reservation date.
Rescheduling is subject to:

  • Availability,

  • Staffing,

  • Package pricing changes,

  • Payment of applicable administrative fees.

Events cancelled within 7 days of the reservation may remain responsible for the full contracted balance due to scheduling, staffing, preparation, and loss of booking opportunities.
No refunds or credits will be issued for:

  • Late arrivals,

  • Early departures,

  • Reduced attendance,

  • Guest dissatisfaction,

  • Policy enforcement,

  • Weather,

  • Illness,

  • Behavioral removals,

  • Temporary equipment closures,

  • Facility rule enforcement.

Disputes & Governing Law
This Agreement shall be governed by the laws of the State of California.
Any dispute arising under this Agreement shall be resolved exclusively in the county where the Enchanted location hosting the event is located.
Client agrees to attempt to resolve disputes informally before initiating legal action.
To the fullest extent permitted by law, Client waives the right to participate in any class action against Enchanted.

Severability
If any provision of this Agreement is found unenforceable or invalid under California law, the remaining provisions shall remain in full force and effect.

Acceptance of Terms
By submitting payment, signing electronically, booking online, or attending the event, Client confirms they:

  • Are at least 18 years old;

  • Have authority to enter into this Agreement;

  • Understand and agree to all Terms and Conditions outlined above.
